Waiver & Release Agreement
WAIVER & RELEASE AGREEMENT

1. EVENT PARTICIPATION AND CAPACITY

For the purposes of this Waiver and Release Agreement (“Agreement”), “Participant” refers to any individual who registers for and/or takes part in the Fitness4Smiles event (“Event”).

The Event is organised by The Smile Mission Ltd, operating the Smile Asia platform and brand for the purposes of this Event (“Smile Asia”), together with True Yoga Pte Ltd, True Fitness Pte Ltd, True Fitness (STC) Pte Ltd, their parent company, subsidiaries, affiliates, related companies, directors, officers, employees, instructors, agents and representatives where applicable (collectively, “True Group”). Smile Asia and True Group are collectively referred to as the “Organisers”.

Participation in the Event is limited and will be allocated on a first-come, first-served basis. The Organisers reserve the right to reject or decline registrations in the event of overwhelming response, capacity limitations, safety concerns, or other reasonable operational reasons.

2. PHYSICAL CONDITION AND RISK ACKNOWLEDGEMENT

The Participant acknowledges that the Event involves physical activity that may be strenuous and carries inherent risks, including injury, illness, physical discomfort, abnormal bodily changes, or aggravation of pre-existing medical conditions.

The Participant confirms that they are physically fit and able to participate in the Event and have not been advised otherwise by a qualified medical professional. The Participant is responsible for assessing their own physical condition before and during participation.

The Participant agrees to stop participating immediately if they experience pain, dizziness, shortness of breath, discomfort, abnormal symptoms, or any condition that may make continued participation unsafe.

The Participant voluntarily assumes all risks associated with participation in the Event, including the use of True Group’s equipment, premises and facilities.

The Organisers are not obligated to assess the Participant’s physical condition prior to or during the Event.

3. COMPLIANCE WITH INSTRUCTIONS AND VENUE RULES

The Participant agrees to follow all reasonable instructions, safety directions, venue rules and operational requirements issued by the Organisers, instructors, staff, volunteers or venue personnel.

The Organisers reserve the right to refuse entry to, or remove from the Event, any Participant whose conduct is unsafe, disruptive, inappropriate, or in breach of this Agreement or venue rules.

4. RELEASE AND INDEMNITY

In consideration of being permitted to participate in the Event, the Participant, for themselves and on behalf of their heirs, executors, administrators and assigns, releases and discharges the Organisers from claims, demands, damages, expenses, actions and causes of action arising from or in connection with their participation in the Event, to the fullest extent permitted by law.

Nothing in this Agreement excludes or limits any liability that cannot be excluded or limited under applicable law.

The Participant agrees to indemnify and hold harmless the Organisers against liabilities, claims, losses, damages, costs and expenses arising from the Participant’s breach of this Agreement, negligence, wilful misconduct, failure to follow instructions, or damage caused by the Participant to any person, equipment, premises or property.

5. FIRST AID AND EMERGENCY ASSISTANCE

In the event of injury, illness or emergency, the Participant consents to the Organisers arranging reasonable first aid, medical assistance or emergency support where considered necessary. The Participant acknowledges that the Organisers are not responsible for medical costs incurred by the Participant, except where such responsibility cannot be excluded under applicable law.

6. MEDIA RELEASE

By participating in the Event, the Participant grants the Organisers the right to photograph, film, record or otherwise capture the Participant’s image, likeness, voice and participation during the Event.

The Participant agrees that such photographs, videos, recordings or other media materials may be used by the Organisers for legitimate purposes, including event documentation, reporting, publicity, marketing, fundraising, donor communications and promotional content, without payment or further approval.

Such materials may be used in printed collaterals, websites, social media platforms, presentations, reports and other publicity or communications platforms of the Organisers.

7. PERSONAL DATA COLLECTION, USE AND DISCLOSURE

The Participant consents to the collection, use and disclosure of their personal data by the Organisers for purposes reasonably connected with the Event, including registration processing, identity verification, event administration, safety management, communications relating to the Event, record-keeping, reporting, publicity and post-event follow-up.

The Participant acknowledges that their personal data may be shared between the Organisers and with authorised service providers, vendors, volunteers, photographers, videographers, technology platforms or other parties engaged for purposes connected with the Event.

The Organisers may contact the Participant regarding future events, campaigns, donation appeals and related activities through email, SMS, phone or other communication channels, in accordance with applicable law.

The Participant may withdraw consent for marketing-related communications by sending a written request to info@smileasia.org. The Organisers will process such requests within a reasonable time.

The Organisers will take reasonable steps to protect the personal data in their possession or control from unauthorised access, collection, use, disclosure, copying, modification, disposal or similar risks.

8. EVENT MODIFICATIONS AND CANCELLATIONS

The Organisers reserve the right to modify, delay, postpone or cancel the Event at their discretion, including for safety, operational, venue, capacity, public health, regulatory, weather-related or other reasons beyond their reasonable control.

Such circumstances may include, without limitation, acts of God, industrial action, floods, health epidemics, restrictions imposed by authorities, venue issues, technical failures or other force majeure events.

The Organisers shall not be liable for any loss, cost or expense arising from such modification, delay, postponement or cancellation, except where otherwise required by law or expressly stated by the Organisers.

9. PARTICIPANT AGE

Participants must be at least 18 years old, unless the Organisers expressly permit participation by minors with the consent of a parent or legal guardian.

Where a minor is permitted to participate, the parent or legal guardian registering the minor confirms that they have read, understood and accepted this Agreement on behalf of the minor.

10. ACCEPTANCE OF TERMS

By registering for and/or participating in the Event, the Participant confirms that they have read, understood and agreed to the terms of this Waiver and Release Agreement.
